Digg is illegal? Web Content Legality?

I heard that technicaly it's illegal to link to information. Also it's illegal to rephrase things. How do big websites like DIgg do both? Also, for my own website, how could I go about using pictures like that of Mario (nintendo). Does everyone on the entire internet ask for permissiont to use those sort of characters for like, the background?
